1. Scope of Application

The general conditions of sale detailed below (hereinafter referred to as the “General Conditions”), govern the contractual relationship between any customer of the products sold on the website www.melleo.design
(hereinafter referred to as “the Customer”) and Mademoiselle O Design e-shop, www.melleo.design belonging to the company LUX IN ART whose VAT number is IT04154840237 and registered at the Chamber of Commerce
and Industry, Crafts and Agriculture of Terni (Italy) under the number TR – 105888. Mademoiselle O is a trademark of Lux in Art. Lux in Art’s main activity is the sale of art prints and antique and traditional engravings;
Mademoiselle O, its graphic design brand, has for main activity the sale of goods on the site of www.melleo.design.

These general conditions of sale are the only ones applicable and replace all other conditions, except preliminary,express and written derogation. Lux in Art may occasionally be required to modify certain provisions of its general conditions. Consequently, it is necessary that the Customer reads the version in force on the day of his order on the Site. These modifications are opposable to the Customer from the time they are put online and will be applied to orders after the date of posting. Any purchase on the Site is subject to all clauses of the General Conditions of Sale. The Customer will not be able to validate his order until after having duly read and accepted them by checking the icon dedicated for this purpose.
By validating the General Terms and Conditions of Sales, the Customer declares having the legal capacity to conclude a contract within the meaning of the Italian Civil Code. The Customer must guarantee the veracity and
accuracy of the information provided and use the site in accordance with the general conditions of sales. Lux in Art reserves the right to cancel or refuse any order from a customer with whom there is a dispute over the payment of a previous order.

 

2. Products and definitions

The products sold on the site Melleo.design are graphic art design printed on various media and framed or not.
These prints are available in several formats, on multiple media, in limited edition and numbered or not,depending on the different collections. Mademoiselle O Design strives to maintain its catalog up to date, however
in view of some limited edition collections, it is possible that a product appears available on the site for a few days while the edition has been exhausted. In any case, only the confirmation of the purchase by mail of Melleo.design
guarantees the Customer the availability and delivery in the Terms and Conditions.

 

 

3. Price

Prices are quoted inclusive of all taxes, excluding shipping costs. Only payments in euros are accepted on thesite Melleo.design.
The price to be paid may be reduced by a discount (eg coupons or vouchers). The price will be final only upon confirmation of the order.
Mademoiselle O reserves the right to change its prices at any time. Works will be billed based on the rates in effect at the time of registration of the order.
The works remain the property of Mademoiselle O and Lux in Art until full payment of the indicated price.
In the event of a change in the VAT rate (VAT in force in Italy), the price will be automatically modified without further notice than the legal date of payment of the new rate.

 

4. Order Process

In order to place an order, the customer will necessarily follow the following steps:
– Consultation of the page of a work. For each product, the customer will have to choose the options (color or black and white, its size and the option framed or not (with its color) and the desired quantity.
– Click on the “add to cart” button. The customer can then go directly to the payment on his basket page, or continue shopping on the site Melleo.design.
– Cart page: The customer can delete an article or modify the quantities ordered and view the options chosen.
– Identification or account creation page: the customer can identify himself on the “Log in” page or to create a new
account if he is a new customer by clicking as indicated. Business customers will have to go through the “ProSpace” link on the homepage.
– Address page where the customer can choose their delivery and billing addresses
– Payment page: the customer can use his discount coupon, select his method of payment and check the various
components of the order.
– The customer must then accept the present general conditions of sale to confirm the order and proceed to the
payment according to the chosen method. Their acceptance is done by checking the box in front of the link to
these conditions.
– The order is effective when the settlement is confirmed by the bank, which will be notified to the customer by email.

If you don’t remember your password, click on “Lost your password” and follow instructions.
If the customer does not have an account yet, he/she needs to fill in all the fields of identification (B2B customer,
last name, first name telephone, address, postcode, region/state, city, country, VAT number, email, company)
The customer can click on the box “Create an account” ” in order to be able to register easily its account for a future purchase. In that case, he/she has to choose a password and to confirm it.

5. Means of payment and security

Several payment methods are available on the Melleo.design website:
• Bank transfer
• Credit card, Visa, Mastercard
• Paypal
• Stripe
For any bank transaction (credit card, Visa, Mastercard) the bank transaction is processed by Paypal. In this case,
the customer does not need to have a Paypal account. However, click on Paypal mode. Melleo.design never has
access to your banking information. In addition, all information is encrypted using SSL and cannot be intercepted
or modified.
In the case of a payment by bank transfer, the production of your order will only start once the transfer is received,
which generally adds a few days to the treatment of the order. You will find our bank details during the payment
process of your order.
Lux in Art shall not be liable for damages resulting from the use of electronic means of communication, including
but not limited to – damages resulting from failure or delay in the transmission of electronic interception or
manipulation of electronic communications by third parties or by computer programs used for electronic
communications and for the transmission of viruses.

 

6. Delivery

The shipping costs are based on the total amount of the order and the destination. Lux in Art works in partnership
with UPS.
The Customer must carefully complete all the fields of the delivery form, including his delivery address and a telephone number, at the time of the order. Neither Lux in Art, nor the company UPS can be held responsible for
a delivery failure due to inaccuracy or error in the delivery address.
Delivery times are approximately 8 working days on average. Due to the on-demand manufacture of the Products and their craftsmanship, these deadlines may vary and Lux in Art cannot be held responsible. In any case, the
delivery time of the Products will not exceed three (3) weeks from the receipt by the Customer of the confirmation

of his order, except in case of force majeure or exceptional case, in which case the customer in will be informed by e-mail previously.
Prices and shipping costs are quoted in Euros and are calculated based on the customer profile, the total amount of the order and the country of delivery. They follow the following scale:

 

European Union:

 

> Private customers:
20 € for any order under 500 € / free for any minimum order of 500 €.
> Professional customers:
30 € for any order less than 2000 € / free for any minimum order of 2000 €.
Outside European Union:
> Private customers:
30 € for any order under 1000 € / free for any minimum order of 1000 €.
> Professional customers:
20 € for any order between 0 and 1000 €
30 € for all orders between 1000 € and 2000 €
Free for orders over 2000 €
The European Countries include:
Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Germany, Greece,
Hungary, Ireland, Italy, Lithuania , Latvia, Luxembourg, Malta, the Netherlands, Poland, Portugal, the Czech
Republic, Romania, the United Kingdom (England, Scotland, Wales), Slovakia, Slovenia and Sweden.
The price is payable in full and in one payment to the order. All orders are invoiced and payable in Euros only. For
any delivery outside Italy and France, any customs fees or local taxes remain the responsibility of the recipient.
Our product offers and prices are valid as long as they are visible on the site, while stocks last. For products not
stored in our warehouses, our offers are valid subject to availability from our suppliers (especially for framed
works). In this context, indications on the availability of products are provided at the time of placing your order or
consecutively to your order.
In the event of unavailability of non-stocked products after placing your order, we will notify you by mail upon
receipt of information provided by suppliers. Unless you want a replacement for equivalent hardware, your
unavailable order will be automatically cancelled and you will be refunded if your bank account has been debited.
On the confirmation email, the customer can access the UPS tracking number and follow the progress of his order.
It is then enough for the customer to connect to the UPS website to follow his delivery in real time.

7. Receipt of Delivery and Right of Return

Upon delivery, the buyer is required to check the merchandise. Any reservations he intends to make concerning
the condition of the goods delivered must be mentioned on the delivery form.
In the absence of a mention on the delivery form, no complaint will be accepted after receipt of the goods, except
in case of hidden defect.

 

8. Force Majeure

Lux in Art can not be held responsible for a delay or impossibility of processing the order of a customer arising
from one or more external events, beyond his control and control and reasonably insurmountable, defined as
events of force majeure as defined by applicable law and the items below.
Will be considered as events of force majeure, in particular, destruction of equipment, computer attacks or
hacking, deprivation, removal or prohibition, temporary or permanent, and for any reason whatsoever, access to
the Internet network and cases recognized according to case law.

 

9. Cancellation and withdrawal

In accordance with Article L121-20 of the Consumer Code, the customer has a right of withdrawal, without giving
reasons, to return a product within 14 days after confirmation of order. This right does not apply to gift vouchers or
orders placed by companies.

the subject of the e-mail.

 

10. Return of goods

For any order on melleo.design website, in addition to the legal withdrawal period of 14 days after the order
confirmation, the customer has a period of 7 calendar days from receipt of the order to return the product(s) in the original packaging.
The Customer must contact Mademoiselle O customer service as soon as possible by e-mail:shop@melleo.design. The returns will be free in the only case where the product is returned in its packaging and its state of origin; the customer will then receive a return form by e-mail to be filled in and returned by e-mail to:
shop@melleo.design. The customer service will connect the customer with UPS to recover the product.
As indicated on the coupon provided for this purpose, the product must be returned to LUX IN ART – Piazzetta
Serego 4, 37121 Verona, Italia. If you have lost the UPS delivery order, please contact our customer service
department by email: shop@melleo.design or by phone +39 045 6938437 or +33 (0) 661 825287 (9.30am –
6.30pm Monday to Friday). If the returned product is in its original state, the refund period is 30 days maximum
from the date of receipt of the product by Mademoiselle O. The refund will be made by bank transfer to the
account used for settlement or on the Paypal account. Mademoiselle O will refund the price of the returned items.
The initial shipping costs will be refunded only in case of defective product or with a hidden defect.

 

11. Warranty and Liability

Lux in Art guarantees the conformity of the products sold on the site with the prescriptions of the Italian law.
Lux in Art reserves the right to correct, at any time and without prior notice, the content and information published on the site Melleo.design. Lux in Art does not guarantee the accuracy of this information (including but not limited to descriptions of works, artist biographies, dates, etc.).
Lux in Art declines any responsibility for any interruption of the website, any occurrence of technical problems,any inaccuracy or omission relating to the information available on the website, any damage resulting from a fraudulent intrusion of a third party having caused a modification of the information put available on the website.
Lux in Art can not be held responsible for access problems or third-party website content, even if they are partners displaying a link on Melleo.design.
Lux in Art will not be liable for damages arising from the use or inability to use the Site or malfunctions attributable to third-party software incorporated in the Site;The choice and purchase of a product are under the sole responsibility of the Customer.

 

12. Intellectual Property

 

a) Mademoiselle O

Mademoiselle O is a protected trademark registered at the INPI and melleo.design is a domain name also protected. They are the exclusive property of Lux in Art and can not be used without our prior consent. Any link with other sites without the prior agreement of Lux in Art is strictly prohibited.
All elements on the site and the site itself are protected by copyright, trademark law, designs and / or other intellectual property rights. By elements, we mean in a non-exhaustive way: photographs, images, drawings,
illustrations, texts, videos, logos, screensavers, wallpapers, brands, models, software … These elements belong to the company Lux in Art or are used with the agreement of their owners.
As for the photographs of the prints, Mademoiselle O exploits them on its website under the right of representation in agreement with her partners.
As such, any reproduction, representation, use, adaptation, modification, incorporation, translation,commercialization, partial or complete by any process and on any medium whatsoever is prohibited, without the
prior written permission of Lux in Art.

 

b) Artworks

The artist or rights holders retain copyright in works within the meaning of Italian law. The rights of representation and reproduction of works are governed by a contract between Lux in Art and its partners and graphic designers artists. The joint authorization of Lux in Art and its partners is therefore necessary for any exploitation of these rights.
For each sale, Lux in Art pays a defined percentage to the beneficiaries. Copyright is included in our selling price.
Lux in Art fully manages the rights and ensures that the exploitation of all these images is done in a transparent manner, respecting the rights of reproduction and copyrights.
The sale of works on Melleo.design gives right to a private use. It is understood as the sale of a body object and
does not imply any transfer of the intellectual property rights attached to the original work.

 

13. Variable profiles and prices by profile

The site Melleo.design is accessible for individuals and professional retailers.
Prices displayed by default are those intended for the general public (individuals). They are available with or without registration on the site.To access to prices for professional retailers, it is necessary to register in the space reserved for professionalsentitled “Pro Area”. Prices will be available after validation of the profile by Mademoiselle O. These prices are valid for a minimum purchase of 1000 € (VAT included).Shipping fees are to be added to the price of the product (see point 6. Delivery).

14. Protection of confidential data

Lux in Art is committed to protecting the privacy of its visitors and customers.
In accordance with the Data Protection Act of 6 January 1978, you have the right of access, modification,rectification and deletion of the data concerning you. You can exercise this right by sending us an email(hello@melleo.design) or a letter to the following address:

Mademoiselle O undertakes not to assign or rent Personal Data.Personal Data is primarily used to manage Customer orders.Upon Registration, the customer agrees to consent to the use of his email address for any communication from Melleo.design, including but not limited to the newsletters of Mademoiselle O. The customer may choose to unsubscribe from these communications using the link provided for this purpose in the emails received.Mademoiselle O makes every effort to ensure the confidentiality and security of any data that may be seized or transmitted on its services, but could not be held responsible for their accidental deterioration, loss, or “hacking”
that may occur despite all precautions taken. The user of the service, whether subscriber or not, therefore releases Lux in Art from any lawsuits and any claims for damages resulting from the loss and / or piracy of data.
The customer who submits his personal data for the purchase of a product will have to confirm his agreement concerning the privacy policy before validating his order, by checking in the corresponding checkbox.

 

15. Applicable law

These general conditions of sale are subject to Italian law. Any litigation relating to the validity, interpretation and / or execution of these General Terms and Conditions of sales, even in the case of a warranty claim or multiple defendants, will be the exclusive jurisdiction of the Commercial Court of Terni.

 

16. Severability of clauses

The fact that any clause of the General Terms and Conditions becomes null and void, unenforceable, obsolete,illegal or unenforceable because of a law, a regulation or following a court decision, shall not affect the validity,the legality, the applicability of the other stipulations of the General Conditions and will not exonerate the Customer or Lux in Art from the fulfillment of its contractual obligations.
